BackupYourData is a brand of, and is operated by, Fortify 24x7 ("Fortify 24x7", "we", "us"). Purchasing or using a BackupYourData subscription constitutes your acceptance of these terms. Please read them. They are deliberately short.
Section 01What you are buying
Managed data backup and recovery service, sold per unit and operated by Fortify 24x7 on enterprise backup infrastructure. Coverage lines include workstation, server, virtual machine, Microsoft 365, Google Workspace, QuickBooks Online, and Entra ID protection, together with scheduled recovery testing. Cadence, retention, and storage allowances are those stated on the product page for the line you purchased.
Section 02Billing
Every line is charged monthly and in advance, priced by the unit shown at purchase: a device, a user, a company file, or a tenant. Stripe processes the payment. Charges appear on your statement as FORTIFY 24X7. Renewal is automatic each month until you cancel, and a change of quantity applies to the next invoice rather than the one already settled.
Section 03Cancellation
You may cancel at any time from the billing portal or by writing to us. Cancellation stops the next renewal; the coverage you have already paid for runs to the end of that period and then ceases. Refund terms are set out in the Refund Policy.
Section 04Your data
What we hold for you is encrypted with 256-bit AES at rest, protected in transit, and kept in infrastructure separate from the systems it covers. The data remains yours. Our personnel access it only where operating the service requires it, where you ask us to, or where the law compels us. The Privacy Policy sets out the detail.
Section 05Your responsibilities
- Installing the agents we provide, or authorizing the cloud platform connectors, so that the jobs can run.
- Keeping payment details current and keeping your account email address reachable. That address receives failure notices and your sign-in links.
- Confirming that what you purchased matches what you intended to protect. We bill the quantities you selected, and we cannot back up a machine or a mailbox that nobody placed in scope.
Section 06Service levels and liability
The service is delivered with commercially reasonable skill and care. Some of what backup and recovery depend upon is not within our control, including your connectivity, the availability of the systems being protected, and the interfaces of the platforms we back up. So far as the law permits, our aggregate liability on any claim is limited to the fees you paid in the three (3) months preceding it, and indirect or consequential loss is excluded.
Section 07Changes to these terms
We may revise these terms. Material changes are emailed to you at least 30 days before they take effect, and continuing to use the service after that date constitutes acceptance of them.
